- Applicability
These General User Terms apply to the use of the lockers of Mobile Locker De located at one fo the Deutsche Bahn stations regarding the safekeeping of items by the user in the lockers operated by Mobile Locker DE.
All agreements entered into by Mobile Locker DE are eclusively governed by German law. Disputes arising from an agreement to which these terms apply will be adjudicated by the competent court provided that the couterparty is granted a period of one month after Mobile Locker DE has invoked this clause in writing to choose the court competent under the law for the settlement of the dispute.
- Offering and Acceptance of Luggage
2.1. Upon request, the contents of the luggage must be shown. Mobile Locker DE is entitled to refuse the offered luggage without stating reasons.
2.2. If valuables or luggage worth more than 500 euros are nevertheless placed in a locker, the agreement is deemed not to relate to those valuables. Furthermore, no valuables may be offered or stored, including but not limited to jewelry, artworks, money, travel checks/ documents, electronic devices including peripherals, etc.
2.3. If valuables or luggage worth more than 500 euros are nevertheless placed in a locker, the agreement is deemed not to relate to those valuables. or it is deemed to only relate to those items that have a combined value of 500 euros. The storage of luggage with a value exceeding 500 euros is at the counterparty’s risk
- Formation of the agreement
3.1. Agreements concerning the provision of lockers are concluded as soon as the counterparty has obtained actual control over a locker according to the prescribed prcedure for that locker.
3.2. Deviations fromt the agreement and/or promises made by staff member of Mobile Locker DE are only binding for Mobile Locker DE if and insofar as these agreements have been confirmed in writing by Mobile Locker DE.
- Inspection, Destruction, and Removal of Luggage
4.1. If the luggage is stored in a locker provided by Mobile Locker DE, a staff member of Mobile Locker DE is authorized to open that locker and inspect its contents, even if the luggage is entrusted to Mobile Locker DE in a suitcase, box, or similar.
4.2. Luggage that Mobile Locker DE deems dangerous or a nuisance, such as explosives, chemicals, perishable goods, living beings, etc., may be destroyed or removed at the counterparty’s expense by Mobile Locker DE, or sold, without the counterparty being able to make any claims in this regard
- Use of the locker (exceeding storage or usage period
5.1. The luggage must be collected during the specified opening hours and before the end of the reserved rental period. After the rental period has expired, an additional fee will be charged per hour. The lockers will only be opened once the due fees have been fully paid.
5.2. If Mobile Locker DE staff must come on-site for a reason not attributable to Mobile Locker DE, the following fees apply:
- If by appointment (next day): €25
- If urgent and not by appointment: €50
5.3. 48 hours after the expiration of the rental period, Mobile Locker DE is entitled to store the luggage elsewhere. If a total of 6 weeks have passed without the luggage being collected, the counterparty has forfeited their right to it. Mobile Locker DE is then entitled to sell or destroy this luggage, without the counterparty being able to make any claims against Mobile Locker DE in the case of destruction. If the luggage needs to be shipped, the rental price, an administrative cost of €50, and shipping costs must first be settled.
5.4. Intermediate opening of the locker is not possible. A new payment is required for reusing a locker. Thereafter, a new locker, which may not necessarily be the same, will be assigned by the system.
- Liability
6.1. Mobile Locker DE is only liable for damage to or loss of items in a locker to the extent that it is due to the malfunctioning of that locker and to the extent that this damage and loss are not covered and compensated by insurance taken out by the counterparty. A locker is deemed not to be functioning correctly only if it doe not operate according to the specifications applicable to the locker. Under penalty of forfeiture of all rights, the counterparty must check whether the locker is empty and clean and that all parts of the locker are functioning properly before using the locker. When closing the locker, the user must cerify that the locker door is securely locked.
6.2. If Mobile Locker is liable this liability, is at all times limited to an amount of €5OO,00 (including VAT) per locker.
6.3. If the counterparty’s luggage causes attributable damage to Mobile Locker DE or to the luggage of third parties, the counterparty must compensate Mobile Locker DE for this damage.
- Damage notification and payment of damages
7.1. In case of damage or loss, the counterparty must immediately notify the authorized staff member of Mobile Locker DE via hilfe@mobilelocker.de. if there is a suspicion of theft, a report must also be made immediately to the police on site. Furthermore, the counterparty must inform Mobile Locker DE in writing as soon as possible, but in any case within 48 hours after discovering the damage, specifying the circumstances under which the damage occurred and sending a copy of any report to the police.
7.2. The mount of compensation for damages will be paid by Mobile Locker DE withing four weeks after the final determination of our liability and the amount of compensation. If missing goods are subsequently found, the counterparty is obliged to take back these goods and to refund any compensation already paid.
- Usage data of lockers
For establishing the facts concerning the use of lockers, unless proven otherwise, the data stored or recorded in the registration system for the respective locker are decisive; these can be requested by the user from Mobile Locker DE and are maintained solely for that purpose.
